Are Court Records Public in Cass County?
Yes. Court records are public in Cass County under the Nebraska Public Records Law. According to the provisions of this law, all documents created or maintained by government agencies, including courts, are public records, and the public can, at any time, submit requests to inspect or copy them.
However, certain court records are exempt from disclosure, and requests for such records are typically denied or rejected by the record custodian. Examples of exempt records include:

Cass County Criminal and Civil Records
Both of Cass County's courthouses handle criminal and civil cases. However, while criminal felony cases and civil cases of more than $53,000 are heard in the Cass County District Court, criminal misdemeanors, civil cases of $53,000 or less, and small claims of $2,700 or less are heard in the Cass County Court.
Civil cases include personal injury lawsuits, medical malpractice claims, contract disputes, landlord-tenant disputes, etc.
Court clerks at each courthouse are responsible for maintaining and providing access to records of cases adjudicated within their respective courts. Alternatively, individuals can use the "Nebraska Case Information Search" service to find Cass County criminal and civil court records online. This includes the "JUSTICE One-Time Court Case Search" for single searches by party names, which costs $15 per search and returns up to 30 records. There is also the "General Searches" for cases, which is free. However, viewing the details of any case returned in a general search is $1.00.
Cass County Marriage Records
The Cass County Clerk’s Office is the custodian of marriage records in Cass County. These records are available to interested persons for inspection and copying. However, only the spouses (or their immediate family members) can request certified copies.

Cass County Divorce Records
The Cass County District Court handles all divorce cases in the county. While anyone can request divorce records from the district court clerk, certified copies are only available to the spouses, their immediate family members, and their lawyers.

Cass County Birth Records
The Nebraska DHHS is the custodian of birth records for Cass County. Birth records are not public records. Only the registrant, their parents, guardians, legal representatives, and persons with written consent from the registrant can obtain Cass County birth records.
People obtain birth records for different reasons, but the most common ones include proving their identity when applying for passports, driver’s licenses, and SSNs; supporting legal cases (i.e., inheritance claims); and establishing eligibility for military service.
Eligible individuals can obtain Cass County birth records from the DHHS vital records office by ordering them online or by submitting a completed "Birth Certificate Application Form" by mail to:

Cass County Death Records

Cass County Property Records

The Cass County Register of Deeds and the Cass County Assessor are the official custodians of property records within the county.
