Cass County Arrest Records
Persons arrested in Cass County are usually held at the Cass County Corrections Jail, where they are booked and then released on bail or detained until they are arraigned in court. During this process, the arresting agency documents personal information about the suspect, events surrounding the arrest, and details of the officers involved. The information gathered during booking is used to create an arrest record for the suspect. This record can then be updated with the suspect's interactions with the county’s criminal justice system.

These records are usually maintained by the Sheriff's Office and other local police departments in Cass County. Expunge Cass County Arrest Records
Nebraska Revised Statutes Section 29-3523 governs the expungement process in Cass County. An expungement, as defined by law, implies the erasure and physical destruction of a created arrest record, making it unavailable for public access. An individual whose records have been expunged may deny the existence of such records. For an arrest record to be eligible for expungement, it must satisfy the eligibility criteria and waiting periods described in section 29-3523(3) of the Revised Statutes.
Qualifying individuals may process their expungement by following the steps outlined below:
- Step 1: Gather all necessary documents needed for the expungement application. This includes court records, booking records, criminal history records, and the arrest record to be expunged
- Step 2: Obtain legal help in filing the petition for expungement. The petition is to contain vital information about the record(s) to be expunged and reasons for the expungement
- Step 3: Serve a notice of the field petition to all agencies and parties connected to the arrest, such as the arresting agency and the prosecutor
- Step 4: Wait for the court to fix a hearing date and decide whether to grant the petition or not.
Once the court grants the petition, an order mandating the destruction and erasure of the affected records is issued and served to the relevant authorities. Expunged records become publicly available but may be accessed with a court order or by entities authorized by law.
