A Sarpy County peace officer can make an arrest with or without a warrant. Per Neb. Rev. Stat. § 29-404.02, a peace officer can arrest without a warrant when there is a reasonable cause to believe that a person has committed:
- A felony
- A specific criminal offense to a household member(s) in the officer’s presence or absence.
- A misdemeanor and an immediate arrest is necessary, or the offense was committed in the presence of the officer.
An officer who arrests a person without a warrant must present the court with an affidavit explaining the basis for the arrest within 48 hours. If the court decides from the affidavit that probable cause exists, the arrested person will remain in custody. Otherwise, the arrested person will be released. The arresting officer will file a complaint with the court between 24 and 48 hours after the probable cause finding is found. The officer must bring the person arrested without a warrant and who is in custody before a Sarpy County court for an appearance within seven days of the arrest. The appearance can be remote through videoconferencing or in person.
The Sarpy County Department of Corrections is responsible for maintaining all arrest records. The search criteria are by A-Number or biographical information. They can also request arrest records at any ICE local field offices and detention facilities during business hours.

Free Arrest Record Search in Sarpy County
The Sarpy County Department of Corrections has an Inmate Current Booking page where individuals can freely find arrest information. Users can click column headers to sort the search. Alternatively, individuals can use third-party portals to find arrest records for free. Most of these portals permit name-based searches. They return arrest information on all arrestees bearing the searched name. Users would need to know other information about the arrestee or the arrest to locate the desired record. Unfortunately, free access provided by third-party databases returns limited search results. Users must pay a small fee for extensive searches.

Sarpy County Arrest Records Vs. Criminal Records
The content of arrest and criminal records differ. Criminal records are usually more comprehensive than arrest records. An arrest record is a document that Sarpy County police officers complete after arresting a person. It contains information about the arrested person, the reason for the arrest, and detention. Per Neb. Rev. Stat. § 29-3506, criminal records are information gathered on a person by Sarpy County criminal justice agencies. They consist of the person’s identifiable descriptions and notations of issuance of arrest warrants, arrests, detentions, indictments, charges, and dispositions arising from such arrests (sentencing, correctional supervision, and release).
How Long Do Arrests Stay on Your Record?
In Sarpy County, most arrests remain on record for a person's lifetime. This is because Nebraska has no statutory expungement provision unless the arrest was due to a law enforcement error (Neb. Rev. Stat. § 29-3523(9). However, Neb. Rev. Stat. § 29-3523(3) provides a retention period for some arrest records:
- Arrests with dismissed charges are removed from a person’s record three years after the arrest date.
- Arrests where no charges are filed due to the prosecuting attorney's determination are removed from a person’s records after one year from the arrest date.
- Arrests where no charges were filed due to a completed diversion are removed from a person’s records after two years of the arrest date.
Additionally, the Nebraska Secretary of State’s (SOS) Records Management Division Record Retention Schedules for some arrest records. For example, below are the retention periods of arrest records maintained by County Sheriffs:
- Jail incident reports are kept for five (5) years
- Jail registers are kept for 25 years after the last entries
- Inmate adult files for felony cases are retained for 50 years
- Inmate adult files for misdemeanor cases are kept for 25 years
- Inmate cards showing the discharge of prisoners are maintained for five (5) years
- Inmate adult files, which are notations and maintained in another office, are kept for five (5) years
- Inmate juvenile files are kept for five (5) years after the juvenile reaches the age of majority (age 19)
- Imate fingerprint files for felony cases are maintained for 20 years, while those for misdemeanor cases are kept for ten (10) years.
- Inmate work release is kept for five (5) years
- Offense reports index are kept for five (5) years after the case is closed or when removed from NCIC (National Crime Information Center)
- Active warrant indexes are kept until the warrant has been served or transferred to the inactive index.
- Inactive warrant indexes are kept for five (5) years
Expunge Sarpy County Arrest Records
Expungement of arrest records is rare in Sarpy County, and it's only possible when there is evidence of law enforcement error. Arrested persons can get a clean slate by sealing their records. The Nebraska law does not provide a one-size-fits-all process for sealing arrest records. The process is based on the charges and convictions (Neb. Rev. Stat. §29-3523, 29-3005, and 29-2264). Sealing makes an arrest record unavailable to the public and only open to the record holder, a person the record holder permits, and criminal justice agencies such as courts, prosecutors, and law enforcement. Only individuals whose charges fall within the following categories can have their adult records sealed:
- Conviction-less charges
- Survivors of sex trafficking
- Convictions that have been pardoned
Eligible individuals must file a Motion to Seal an Adult Criminal Record (CC 6:12) at the Sarpy County or District Court. Applicants can file the Form through their attorney or by themselves in person, by mail, or by fax. The court will notify the county or city attorney of the motion, and a hearing will be scheduled. The judge will grant the request to seal the arrest record if there are no objections to the motion. After the approval, the court will update its system, and the record will be sealed a few days after the hearing.
Sarpy County law enforcement agencies automatically seal juvenile arrest records from public view (Neb. Rev. Stat. § 43-2,108.03). Only the record holder, someone the record holder permits, DHHS, law enforcement agencies, judges, county and city attorney offices, and probation officers can access juvenile arrest records. Juveniles whose arrest records do not qualify for automatic sealing can request sealing when they reach the age of 18 or six months after the case was closed. Juveniles or their parents can seal their arrest records by filing:
- A Motion to Seal Records (Juvenile) if their case was heard in Sapry County Juvenile Court.
- A Motion to Seal Records (County Court) if their case was heard in Sarpy County Court.
When reviewing the motion, the Court will evaluate whether the youth has achieved a satisfactory level of rehabilitation. If the Court denies the request due to rehabilitation concerns, the youth may submit the request again after a one-year waiting period.
Sarpy County Arrest Warrants
Per Neb. Rev. Stat. § 29-403, county and district court judges issue arrest warrants in Sapry County for the apprehension of individuals charged with a criminal offense. A warrant is only issued if the magistrate, based on the filed complaint, finds reasonable grounds to believe that the alleged offense has been committed (Neb. Rev. Stat. § 29-404). The judge will direct the arrest warrant to the Sarpy County sheriff, the marshal, or another city or village police officer. The warrant will command the officer to arrest the accused and bring them before the issuing magistrate, court, or some other magistrate having cognizance of the case (Neb. Rev. Stat. § 29-406). Arrest warrants can be executed anywhere in Nebraska, and all county sheriffs, coroners, and other officers must aid in the execution of such warrants when required (Neb. Rev. Stat. § 29-407).

Do Sarpy County Arrest Warrants Expire?
No, arrest warrants do not carry a specified expiration date in Sarpy County. This means once an arrest warrant is issued, it remains active until executed or quashed by the issuing judge. However, the officer named on the warrant is expected to execute it in a timely manner. Although an arrest warrant does not expire, there may be a statute of limitation on the alleged offense committed by the accused. Once the statute of limitations has passed, the prosecution may be voided, even though the warrant remains active.
